Welcome to LetzHaff. By accessing or using this website, you agree to be bound by these terms of use. If you do not agree with any part of these terms, you must not use this website.
1. Scope of the Platform
LetzHaff is an online platform that connects consumers with local farms, farm stands, self-harvest fields, and agricultural producers in the Grand Duchy of Luxembourg. The platform allows users to discover farms, view products, read reviews, and find self-harvest opportunities.
LetzHaff does not sell products directly. We act solely as an intermediary platform and are not a party to any transaction between users and farms. Any purchases, reservations, or agreements are made directly between the user and the farm.
LetzHaff operates as an information society service within the meaning of EU Directive 2000/31/EC (E-Commerce Directive) and the Luxembourg law of 14 August 2000 on electronic commerce. As such, LetzHaff acts exclusively as a hosting provider and intermediary, and bears no liability for the content published by farmers or the quality of products offered.
No employment, partnership, or agency relationship exists between LetzHaff and any farmer listed on the platform. Farmers are independent operators who use LetzHaff to present their products and services to consumers.
2. User Obligations
By using this website, you agree to:
- Provide accurate and up-to-date information when required.
- Use the platform only for lawful purposes and in accordance with these terms.
- Not engage in any activity that could damage, disable, or impair the website or interfere with other users' access.
- Not attempt to gain unauthorised access to any part of the website, server, or database.
- Not post defamatory, offensive, fraudulent, or misleading content in reviews or any other user-generated area.
3. User Accounts
Certain features of the platform require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
We reserve the right to suspend or terminate accounts that violate these terms, without prior notice.
4. Account Termination and Data Deletion
You may terminate your account at any time through the account settings in your profile. Upon termination, LetzHaff will anonymize your personal data as described in our Privacy Policy.
LetzHaff reserves the right to retain anonymized, non-personal data for legitimate business purposes, including analytics and legal compliance. Anonymized data cannot be linked back to any individual.
5. Farmer Accounts and Responsibilities
Farms and producers who register on LetzHaff are solely responsible for the accuracy and legality of the information they publish, including product descriptions, prices, availability, and compliance with Luxembourg food safety and labelling regulations.
By listing products or services on LetzHaff, farmers agree to the following obligations:
- Farmers are solely responsible for the accuracy of product descriptions, pricing, images, and availability information displayed on their listings.
- Farmers must comply with all applicable Luxembourg food safety regulations, including the Loi du 18 décembre 2009 organisant la sécurité alimentaire, and any subsequent amendments or implementing regulations.
- Farmers are responsible for maintaining appropriate hygiene and safety standards at their designated pickup locations.
- Farmers must respond to order requests and consumer enquiries in a timely and professional manner.
- Farmers must ensure that all products offered for reservation comply with applicable labelling requirements and are fit for their intended purpose.
LetzHaff reserves the right to remove any farm listing, restrict account features, or terminate a farmer account that fails to meet these obligations or that receives repeated complaints from consumers.
6. Reservations, Pickup & Collection
LetzHaff facilitates the discovery and reservation of farm products. The following terms apply to all reservations and collection arrangements made through the platform:
- Order requests submitted through LetzHaff are non-binding reservation requests until explicitly confirmed by the farmer. Confirmation is at the farmer's sole discretion.
- Consumers must collect reserved products within the timeframe communicated by the farmer. Failure to collect within the specified timeframe may result in the farmer cancelling the reservation without further obligation.
- Farmers may adjust reserved quantities or decline reservation requests based on actual product availability at the time of confirmation or collection.
- LetzHaff is not responsible for product availability at the time of pickup, nor for any changes to quantities, pricing, or pickup arrangements made by the farmer.
- No payment is processed through LetzHaff. All financial transactions, if any, occur directly between the consumer and the farmer. Accordingly, no refund process exists on the LetzHaff platform.
- Consumers are responsible for verifying the condition and quantity of products at the time of collection. Any concerns should be raised directly with the farmer at the point of pickup.
7. User-Generated Content
When you submit reviews, ratings, or other content to the platform, you grant LetzHaff a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content in connection with the operation of the platform.
We reserve the right to moderate, edit, or remove user-generated content that violates these terms or applicable law.
8. Intellectual Property
All content, design, graphics, logos, and software on this website are the property of LetzHaff or its licensors and are protected by Luxembourg and international intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of this website without prior written consent.
9. Limitation of Liability
To the fullest extent permitted by Luxembourg law:
- LetzHaff provides the platform “as is” and “as available” without any warranties, express or implied.
- We do not guarantee the accuracy, completeness, or reliability of any information published by farms or other users.
- LetzHaff shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the platform.
- LetzHaff is not responsible for the quality, safety, legality, or availability of products or services offered by farms listed on the platform.
10. Availability
We strive to keep the website available at all times, but we do not guarantee uninterrupted or error-free access. We reserve the right to modify, suspend, or discontinue the platform (or any part of it) at any time without notice.
11. Modifications to These Terms
We may revise these terms of use at any time by updating this page. The “Last updated” date at the top indicates when the latest revision was made. Continued use of the website after changes are posted constitutes acceptance of the revised terms.
12. Governing Law
These terms of use are governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg, without regard to its conflict of law provisions.
13. Dispute Resolution
Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts of Luxembourg City, Grand Duchy of Luxembourg.
Disputes regarding product quality, product availability, pricing, or pickup arrangements are matters strictly between the consumer and the farmer. LetzHaff is not a party to such disputes and bears no responsibility for their resolution.
LetzHaff may, at its sole discretion, facilitate communication between consumers and farmers to help resolve disputes, but is under no obligation to do so. Any such facilitation does not constitute an admission of liability or responsibility on the part of LetzHaff.
LetzHaff may remove listings, restrict features, or suspend accounts associated with repeated complaints, unresolved disputes, or conduct that undermines the trust and integrity of the platform.
For unresolved disputes, parties may refer to the relevant Luxembourg consumer protection authorities. In accordance with Regulation (EU) No 524/2013, we inform you that the European Commission provides an online dispute resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
